Terms of Service
What Hopout is
Hopout helps you find things to do in the GTA and plan them with friends: suggested plans, places, prices, routes, group votes, circles and events. Hopout is run by Michael Schiavone in Ontario, Canada. It’s free to use, and we may add, change or remove features over time.
Who can use it
- You must be at least 17 years old to use Hopout.
- Plans, places and events involving alcohol are only for people 19 and older (Ontario’s legal drinking age). Give your real age, and never use Hopout to get alcohol for someone under 19.
- You’re responsible for what happens under your account, so keep your devices and sign-in secure.
- One person, one account. Don’t pretend to be someone else.
Place information is a guide
We work hard to keep places real and accurate, but prices, opening hours, age rules, “how busy” estimates, travel times and costs per person are estimates and can change without notice. Check with the venue (its website or booking page) before you go, especially for prices, reservations, age limits and dress codes.
Hopout doesn’t own or run any of the venues, events, transit or ride services shown in the app, and we aren’t responsible for them, their prices, or what happens there. Bookings and purchases are between you and the venue or service.
Going out safely
- You decide where you go and who you go with. Use good judgment, especially at events hosted by people you don’t know well.
- Drink responsibly if you drink, and never drive impaired. Use transit, a rideshare or a designated driver to get home.
- If you feel unsafe, leave and contact someone you trust. In an emergency, call 911.
- People who host events on Hopout are responsible for their event: that it’s legal, safe, follows age rules, and that any address they share goes only to approved guests.
What you post
You own what you post (posts, photos, ratings, messages, plans and events). By posting it, you give Hopout a non-exclusive, royalty-free licence to store, show and share it inside the app with the people you’ve chosen (for example, publicly on a place page, or with your circle), and to make the small technical changes needed to do that, such as resizing a photo. This licence ends when you delete the content or your account, except for copies other people already shared or that we must keep for legal or safety reasons.
Only post things you have the right to share. Don’t post anything that:
- is illegal, threatening, harassing, hateful or bullying;
- is sexual or violent content, or involves anyone under 18 in any harmful way;
- shares someone else’s private information (like their address or phone number) without permission;
- is spam, a scam, fake reviews, or advertising you weren’t asked for;
- copies someone else’s photos or work without permission;
- encourages drunk driving, underage drinking, or anything dangerous.
You can report a post or photo in the app. We may hide or remove content, and suspend or close accounts, that break these rules or put people at risk, with or without notice.
Using the app fairly
Don’t misuse Hopout: no hacking, overloading or breaking the service, no scraping or copying the app or its place list in bulk, no getting around age rules or other safety features, and no automated accounts.
Other apps and websites
Hopout links to and uses other services, like venue websites, booking sites, Google sign-in and Google Maps, MapTiler maps, and ride apps such as Uber and Lyft. Those services have their own terms and privacy policies, and we aren’t responsible for them. Place reviews and photos from Google are shown as Google provides them.
Our stuff
The Hopout name, logo, design and app are ours. You can use the app for your own personal, non-commercial use, but please don’t copy, sell or reuse them without our permission.
Ending things
You can stop using Hopout at any time, and ask us to delete your account at michael.schiavone20@gmail.com. We may suspend or close an account that breaks these terms, or stop offering Hopout, and we’ll try to give notice when we reasonably can.
No guarantees, and limits on liability
Hopout is provided “as is” and “as available”. We don’t promise it will always be available, error-free, or that information in it is complete or correct.
To the fullest extent the law allows, Hopout and the people who run it are not liable for indirect or consequential losses, or for anything that happens at venues, events, on trips or with other people you meet through the app. If we are found liable for something, our total liability is limited to CA$100. Nothing in these terms removes rights you have under consumer protection laws that can’t be excluded.
Law
These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. Any dispute will be handled by the courts of Ontario, unless the law where you live says otherwise.
Changes to these terms
We may update these terms as Hopout grows. We’ll change the date at the top, and tell you in the app before an important change takes effect. If you keep using Hopout after that, you accept the new terms.
